ALTERNATE PROGRAM FOR FIRST OFFENSE OUI OFFENDERS
The Alternate Program for First Offense OUI Offenders is an alternate sentencing option available to judges sentencing first offense OUI offenders.
This is a community based program whereby the committed offender is sentenced to three (3) days in Penobscot County Jail and approved for participation in a public works project pursuant to Title 30-A MRSA Section 1606.
The offender is housed in either a local school or a community based facility for forty-eight (48) hours. During the course of the forty-eight (48) hours; the offender will perform sixteen (16) hours of community service work and attend a seven (7) hour working seminar on alcohol abuse and its effect on the Individual, the Family and Community.
Upon successful completion of the sixteen (16) hours of community service work, the inmate will receive a one (1) day deduction off their sentence.
Pursuant to Title 17-A MRSA Section 1341 a jail reimbursement fee, of up to $125 per participant, will be assessed and MUST be paid at sentencing to the County Treasurer at the Superior Court Building, 97 Hammond Street, Bangor, Maine 04401.

General Information and Guidelines for Inmates
POLICY:
It is the policy of the Penobscot County Sheriff’s Office as it relates to the Alternate Program for First Offense OUI Offenders to provide a community based sentence which combines community service and treatment.
GENERAL GUIDELINES:
The following information will advise you of the services and policies of the Alternate Program for First Offense OUI Offenders and your responsibilities while you are a resident. They are provided for your benefit and you should familiarize yourself with them.
1. Phone Calls
Phone calls will not be permitted unless it is of an emergency nature or approved by the administration.
2. Visiting Arrangements
Visits will not be permitted during the two day program unless approved by the administration.
3. Searches
Inmates are subject to search (to include strip searches), when a justified reason rises, at the discretion of the administration or supervisor on duty.
4. Medical Care
Emergency medical care is available twenty-four (24) hours a day. Any inmate feeling ill or wishing to see a doctor should notify the officer in charge.
5. Mail
You may send letters if you so desire, provided they are properly stamped. All incoming mail is examined for contraband, with the exception of all legal correspondence which will be opened by the inmate in the presence of an officer.
6. Meals
You will receive three (3) meals per day at approximately 7 a.m., 12 Noon, and 5 p.m. There will be no loud talking or horseplay during meals. There will be no 5 p.m. meal served on the day of admission or the day of release.
7. Money
All money will be secured at the Penobscot County Jail. When processed, you will sign a receipt verifying that is the amount you came into the program with.
8. Clothing
You will be allowed to wear your own clothing during your two day program. Shoes will be worn at all times. The County is not responsible for misplaced or lost items.
9. Authorized Items
Items furnished by the Jail:
A. Razors and shaving creme
B. Sleeping cots
Items furnished by inmates:
A. Clothing: Two (2) sets of underwear, socks, shirts, and pants, and one (1) pair pajamas, one (1) bathrobe, and one (1) belt, and one (1) summer weight or winter weight jacket according to season. Gloves or mittens during winter only. All other types of clothing will be stored in the property room unless permission from the administration is obtained.
B. Bag: one (1) duffel type bag.
C. Footwear: each inmate may have one (1) pair.
D. Medicine: all medication will be retained by the administration unless the Jail Doctor directs otherwise.
E. Bedding: each inmate will be allowed two (2) towels, one (1) pillow, one (1) pillow case, and one (1) sleeping bag (or two (2) sheets and one (1) blanket).
F. Toilet articles: one (1) comb, one (1) toothbrush, one (1) tube of toothpaste, and one (1) bar of soap, one (1) non-aerosol deodorant, and one (1) bottle of clear shampoo. Aerosol cans are not allowed.
Miscellaneous Items which the inmate may bring:
A. Reading material: limited to one (1) book or magazine and required material
for educational course.
B. Jewelry: inmates may retain their watches, rings, and religious medals. The
Jail Administration will not be responsible for lost or stolen articles.
C. Writing material: one (1) writing tablet, envelopes, and stamps are allowed. Felt tip markers are not authorized. You may have one (1) pencil and one (1) clear see through pen.
Items not allowed:
A. Televisions
B. Radios or tape recorders
C. Shorts or cut-offs, belly shirts or tank tops
D. Cigarettes, matches, lighters, or any tobacco products.
All unauthorized items or those items beyond the authorized limit will be confiscated and destroyed.
!!At the discretion of the Jail Administrator or the Sheriff, any and all items may be suspended from the list of authorized items for whatever period of time may be deemed necessary to ensure the safe administration of the program and for the security of inmates and county personnel.
10. Care of Quarters
Inmates will be responsible for keeping their living areas neat and clean. Wake up time will be at 6 a.m. each day. Inmates will be up and dressed by 6:30 a.m. and will have their living area cleaned and beds made by 7 a.m. for inspection. Defacing of the walls, ceiling, floors, bunks, fixtures, bedding or linen in any manner will be dealt with according to State Statutes.
11. Bathing
All inmates are required to shower frequently at times determined by the administration.
12. Programs and Services
Agendas for the two (2) day program will be provided to each inmate upon arrival on Friday.
13. Sentence Reductions
Inmates who are sentenced to three (3) days are eligible to receive one (1) day off their sentence for successful participation in the Public Works Program.
14. Disciplinary Procedures
The Alternate Program for First Offense OUI Offenders has a number of conduct rules for inmates which, if disobeyed, result in some form of punishment. Punishments range from an oral reprimand to loss of program status and returned to the Penobscot County Jail.
It is important to remember that a confined person does have a right to expect all members of the staff to obey the rules and regulations adopted by the Administration. Correctional Officers who impose punishments without complying with the rules or writing a report documenting the violation, is in conflict with jail policy and may be liable for damages.
Any behavior which constitutes a criminal act as defined by the Maine State Statutes will be prosecuted as such.
Infractions: violations of written Jail rules and regulations.
15. Breath/Urine Testing
Inmates will, upon request of Jail Staff, submit to a breath and/or urine test.
16. Check In
All inmates will report in, as directed, no later than 5 p.m. Failure to report as directed my result in the inmate’s return to the Penobscot County Jail.

Alternate Program for First Offense OUI Offenders
The Alternate Program for First Offense OUI Offenders is managed and controlled by the Sheriff, Jail Administrator and their staff only.
Any inmate found to be in violation of an inmate rule or regulation will be subject to disciplinary or criminal action depending on the type of violation.
RULES:
1. Inmates will not show disrespect to jail personnel, citizens of the community, visitors, or other inmates.
2. All inmates will address jail personnel according to rank, or their last name only. (Examples: Sheriff, Captain, Mr. or Mrs. and their last name).
3. Inmates will not have any form of authority over another inmate.
4. Inmates will not change their assigned area without written authorization from the supervisor on duty.
5. All inmates are required to maintain their area and common areas in a clean, sanitary, and orderly condition. All beds will be neatly made. The Jail Administrator or a designee will inspect all areas by 7:00 a.m. each day.
6. Inmates will not disfigure, damage, abuse, or waste county property, or property belonging to another person.
7. Inmates will not assault, or attempt to assault jail personnel, other inmates, visitors, or any other person.
8. Inmates will not incite any overt act that will disrupt the good order or safety of the Jail.
9. Inmates will not commit any lewd or indecent sexual act.
10. Inmates will not possess contraband or attempt to obtain contraband. Possession includes possession on your person, clothing, in your area, or in a place where there is reasonable grounds to believe it is in your control. Anything not received through authorized channels will be considered contraband.
11. Inmates are not allowed to keep cash or valuable items on their person. All such funds and items will be turned in and stored. Inmates will be given a receipt for all funds and items retained.
12. Inmates will not be intoxicated or under the influence of any substance or drug. Inmates who test positive for alcohol or drugs will be returned to the Jail to serve their sentence.
13. Inmates will not disobey an order from a staff member.
14. Inmates will only be in those areas that are authorized.
15. Smoking or using tobacco in any form is prohibited.
